Two Different Claims: Authenticity Guarantee or Standard Listing
Many designer items on eBay are never authenticated before they ship. eBay physically checks some listings under its Authenticity Guarantee, and everything else is a standard sale with dispute rights that start after the item arrives. Which one you bought decides your claim, so settle that first.
This guide is the eBay decision tree: which kind of listing you bought, how the "doesn't match description" return works for counterfeits, what to do when the seller answers with a receipt or a box, and where to go when the seller refuses, eBay rules against you, or the purchase fell outside the guarantee. Our guide to refunds for fake designer items covers PayPal terms and card chargebacks across every platform, so we link there instead of repeating them.
eBay's rules differ by country and change over time. What follows is what eBay's US help pages described when we checked in October 2026. Confirm the current terms in your account before you rely on any deadline.
Do This Before You Open a Case
- Keep everything that arrived with it, including any Authenticity Guarantee card or tag, the original tags, the outer box and the shipping label, and stop using the item. eBay's policy asks for a return in the condition you received it, and an authenticator compares a returned item with what was authenticated.
- Screenshot the listing: title, photos, the words "authentic" or "genuine", price, seller's name and any Authenticity Guarantee checkmark. Sellers can edit or end a listing.
- Keep every message inside eBay. Do not agree a refund or swap by text or WhatsApp, and do not ship anything until eBay gives you a label or instructions.
- Note the delivery date. Your claim window runs from it, not from the day you noticed a problem.
Step 1: Was It an Authenticity Guarantee Listing?
eBay's buying page says eligible listings show an Authenticity Guarantee checkmark and that an authenticated item arrives with a card or tag confirming it was verified. The seller ships to an authentication facility instead of to you, where authenticators check the contents against the listing and run a multi-step physical inspection, generally within 2 business days. If authenticity cannot be verified, eBay says the item is not sent on and you are refunded.
Coverage depends on category, price and brand. When we checked, eBay's US pages gave handbags and accessories from $500, watches from $2,000, sneakers from $100, other shoes from $500, and apparel and jewelry from eligible brands at $200 and $500. Handbags, watches and jewelry also had optional paid tiers at lower prices. Local pickup, customized items, most shipments outside the US, purchases not paid for on eBay and anything the seller posted straight to you fall outside it. Our eBay authentication review covers the gaps.
| What to check | Authenticity Guarantee | Standard listing | Paid outside eBay |
|---|---|---|---|
| Check before delivery | Physical inspection by an authenticator | None | None |
| Your claim | Money Back Guarantee, with returns routed through the authenticator | Money Back Guarantee, reason "doesn't match description" | Outside the guarantee, so your bank or payment provider |
| Main limit | The final sale rule, and the same item in the same condition test | How strong your evidence is against the seller's | eBay excludes any purchase part-paid outside eBay |
If your item was covered
A badge does not make a claim automatic:
- Returns go to the authenticator. eBay says it gives you a label to send the item back to the authenticator, who checks it is the same item in the same condition. If so, you get a full refund. If not, it comes back to you with no refund, which is why untouched tags matter.
- Some purchases are final sale. eBay's policy says its Money Back Guarantee "does not cover final sale purchases on the basis that the item doesn't match the listing." For handbags, eBay defines final sale as both no returns (or a request outside the stated window) and a condition of "New with tags" or "New without tags," so a pre-owned bag does not meet it. Read the listing's return terms.
- Authentication can be partial. An item in the wrong category or modified from original may have only its condition verified, with unauthenticated parts flagged.
We could not find a separate process for an item that passed inspection and is doubted afterwards. Open the claim anyway, say it came through Authenticity Guarantee, and attach specific photographs.
Step 2: Open a "Doesn't Match Description" Return
For a standard listing, and for a covered purchase that is not final sale, this is the main route:
- In Purchases, choose Return this item and the reason that it doesn't match the listing, then add a comment and photos. eBay says this applies even if the seller's policy says no returns.
- The window is 30 calendar days from the estimated or actual delivery date, or the seller's own return window if longer. Some categories are shorter: trading cards sold without returns get 3 calendar days.
- The seller has 3 business days to respond. After that you can use "Ask eBay to step in and help." eBay closes requests with no activity, so do not let a case sit.
- For counterfeits, eBay's policy says you "must request a return but may not be required to ship the item back to the seller," must cooperate in its proper disposal and must not resell it. Wait for the instructions in your case.
Write the claim as facts. "I think it is fake" gives eBay little to act on; "the listing said authentic and the interior code is in a format this brand did not use that year" gives it something to check. eBay says it may decline a request the evidence does not support.
When the Seller Shows "Proof"
eBay's counterfeit policy says that after a buyer report it will review and may ask the seller for proof of authenticity. It tells sellers to keep "invoices from the brand or authorized distributors, serial numbers, grading reports, accepted COAs/LOAs, or assay cards." The page does not say any one of these settles a case, and a plain receipt is not named.
A challenged seller's natural reply is paperwork, which describes a purchase or a package, not the item that reached you:
| What the seller shows | What it can support | What it cannot show |
|---|---|---|
| Receipt or invoice | A purchase was recorded somewhere | That it is real, is the seller's, or is for this item. Receipts can be edited or copied |
| Authenticity card or certificate | That a card exists | That it belongs to this item. Many brands issue none |
| Box and dust bag | That the seller owns packaging | Anything about the item inside. Packaging is easy to reuse |
| Serial number or code in a photo | That a code is present | That the format fits the brand and year. Some genuine items carry none |
| "Bought it from the boutique" | A claim | Nothing, until it is documented and matches the item |
Paperwork can be consistent with a genuine item, but it cannot make one genuine or outweigh a physical tell on the item. Test it against what you hold:
- Dates and codes. A receipt well away from the item's date code does not fit. Our guides for Louis Vuitton date codes, Chanel serial numbers, Prada, the Gucci bag and Rolex serial numbers show how each brand encodes them.
- Description and timing. Model, size and colour should match exactly, and a receipt that appears only after you complain belongs in your notes.
The checks that hold up are on the item: lettering depth, hardware, stitching, interior labels and materials. A good counterfeit can pass several, which is why we explain what a superfake is and what still catches one. A specific failure beats a general feeling in a dispute.
Worth knowing
Do not rely on a code or serial alone, in either direction. A plausible code does not prove an item is real, and some genuine items have none.
If the Seller Refuses, eBay Rules Against You, or It Was Outside the Guarantee
The seller refuses or goes silent
Ask eBay to step in once 3 business days have passed; it aims to resolve cases usually within 48 hours. Its step-in page also says it may ask you to return the item to the seller, so follow your own case's instructions rather than assuming the counterfeit exception applies.
eBay closes the case in the seller's favour
Appeal within 30 calendar days of the case closing, from the case details in Purchases. eBay asks for new information, with examples that include photos showing the item does not match the listing. It normally replies within 48 hours and calls the reply its final decision.
So do not repeat the first complaint. Add the specific tells in close-up photographs and a written opinion from an independent authenticator that names the inconsistent details. We could not find an eBay page saying whether it weighs third-party letters, so attach one as supporting information.
The listing was outside the guarantee, or you paid outside eBay
Many designer listings sit outside Authenticity Guarantee and are standard sales. The Money Back Guarantee conditions we read turn on completing payment on eBay and exclude services, classified ads and vehicles, not on whether the seller is a business or an individual. They also exclude any purchase where part of the payment was completed outside eBay. If that happened, contact your bank or payment provider at once and report the seller. Our refund guide explains how PayPal and card issuers treat payments made outside a platform's checkout.
When to Escalate to PayPal or Your Card
eBay's policy says "a buyer may not seek resolution for the same transaction under more than one buyer protection program," and that it may close your Money Back Guarantee case if you file a chargeback or buyer protection claim with your payment provider, for the full or a partial amount. Its seller pages add that opening a payment dispute closes any open return request or Money Back Guarantee case on that transaction straight away, and that your payment institution decides the outcome, which can take 90 days or more.
Red flag
Filing a payment dispute can end your eBay case immediately. eBay allows one route per transaction, so go to your bank or PayPal when the eBay route is used up, not alongside it.
The usual order is seller, eBay step-in, appeal, then your payment provider. Go to the provider sooner if the payment was outside eBay, eBay's window has passed, or a card deadline will run out while you wait. Card deadlines run from the charge date, separately from eBay's 30 days. Do not file a chargeback after eBay has refunded you; eBay's policy lists that as conduct that removes coverage.
Whether PayPal's own protection or your card issuer applies to an order paid through PayPal at eBay checkout is for them to confirm, so ask before you file. Our refund guide covers PayPal's terms, chargeback deadlines and what banks ask for. Bought on a resale app instead? See buying a fake on Vinted.
Getting an Independent Opinion
Every route above ends at one question: can you show the item is not what the listing promised? An opinion from someone with no stake in the sale carries more weight than your own photos or a receipt.
LuxeDetect issues a signed written statement on our letterhead for marketplace, PayPal and card disputes: a Statement of Non-Authenticity, a Statement of Condition, or a Not As Described statement. It costs $40 and arrives as a PDF within 24 hours of payment. You upload clear photos and your receipt with the request; if the photos do not support the statement you asked for, we tell you and refund the $40. eBay, PayPal and your bank make their own decisions, so no statement can guarantee a result.
For a full verdict before you decide what to claim, you can authenticate the item with photos and receive a Certificate of Authenticity, usually within 24 hours.
FAQ
Is an eBay item with the Authenticity Guarantee badge definitely real?
eBay describes a multi-step physical inspection before delivery and says items it cannot verify are not sent on. No inspection is a promise about every item, so if a delivered item looks wrong, report it promptly and keep the card and tag.
When does the 30-day window start for a "doesn't match description" claim?
From the estimated or actual delivery date, not the day you notice a problem, or from the seller's own return window if that is longer. Some categories are shorter, such as trading cards sold without returns. Open the claim as soon as you doubt the item.
The seller sent a receipt. Will eBay side with them?
Not automatically. eBay says it may ask a seller for proof and lists invoices, serial numbers and certificates as documents to keep, but a receipt only shows that a purchase happened. Compare it with the item and answer with what does not match.
What can I do if eBay closes my case against me?
Appeal within 30 calendar days of the case closing, with new information such as close-up photos of what does not match the listing. eBay calls its reply a final decision, so make the appeal specific. After that, your remaining route is your payment provider.
Will a chargeback cancel my eBay case?
It can. eBay's policy says it may close your Money Back Guarantee case if you file a chargeback or buyer protection claim for the same transaction. Use your payment provider after the eBay route, unless a deadline forces you earlier.
Can I report the seller to eBay?
Yes. eBay's counterfeit policy points people who are not the brand owner to its reporting page, and says sellers who break it can face removed listings, restrictions or suspension. A report is separate from your refund case, and eBay's pages do not say it produces a refund on its own.
